Taking, editing and submission of digital photographs for
display on any of the USAPrepScores.com network of sites by photographers
is a non compensatory venture by USAPS. Images displayed on the
USAPrepScores.com network of sites remain the property of Photographer
and are licensed to USAPrepScores for public display on the Internet.
Photographer also grants USAPrepScores.com a license to utilize
any photos from linked galleries for non-sale promotion on the
USAPrepScores family of sites. Photographs displayed on the USAPrepScores
site and the links to independent photographer's websites are
available for sale at the sole discretion of the photographer
and no guarantees are provided by USAPrepScores as to compensation
for photos. Photographer retains all commercial rights to their
images; however, Photographer has the option of granting USAPrepScores
the authority to license their photographs for commercial use
or to other third parties.
Photographer grants USAPrepScores a perpetual, non-exclusive
and worldwide license for use of images in promotions and display
for USAPrepScores and it's family of sites. This licensed use
of images is granted by Member to USAPrepScores to inform the
public about high school sports, to assist with advertising and
promotion in order to publicize USAPrepScores to the public, and
to enhance the appearance of USAPrepScores Web site and its publications,
advertising and promotional materials.
USAPrepScores may choose to edit or display some or none of
the images submitted by Photographer and photos within the linked
galleries. USAPrepScores reserves the right to selectively edit
images to enhance image quality and increase marketability. USAPrepScores
may also crop and resize images to USAPrepScores' determined optimum
sizes. USAPrepScores may place a watermark on digital images to
discourage unauthorized duplication from the USAPrepScores site.
Photographer is the sole and exclusive owner of all images
supplied to USAPrepScores and of the right to license such images.
The images supplied by Photographer do not knowingly infringe
the copyright, trademark, right of privacy or the publicity rights
of any entity and do not knowingly defame any third party. (All questions and inquiries regarding ownership and licensing of photographs supplied by photographers will be directed to the appropriate photographer.)
Photographer expressly acknowledges and agrees that USAPrepScores
shall not be liable to Photographer for the loss, theft or destruction
of any image that is supplied to USAPrepScores. USAPrepScores
shall promptly notify Photographer in the event that USAPrepScores
discovers unauthorized or infringing use of Photographers image.
Upon receipt of such notice, Photographer shall control any legal
action and shall notify USAPrepScores, in writing, as to the manner
in which Photographer will proceed in respect of such infringement.
Photographer shall not have the right to cause USAPrepScores to
be joined as a plaintiff in any litigation concerning Photographers
image.
In summary what we are saying is that when you submit photos to USAPrepScores.com we will only use the photos in the promotion of our family of websites and that all other requests for usage of your photos will be your responsibility.
